Guide for Plaintiffs: Preparation of Materials When Initiating a Lawsuit

 

1Original Version of Statement of Claim (which shall be affixed with the official seal or signature of the plaintiff)

2Copies of Statement of Claim( which shall be prepared with the official seal or signature of the plaintiff according to the number of opponent parties.)

3Photocopy of the plaintiffs Business License or National Identity Card (which shall be affixed with the official seal or signature of the plaintiff)

4Photocopy of the Organization Registration Code Certificate

5Identity Certificate of the Legal Representative ( which shall be provided with the official seal when the plaintiff is a legal person.)

6 Power of Attorney ( which shall be provided with the official seal or signature of the plaintiff when a proxy is involved.)

7Official Letter of Law Firm ( which shall be provided with the official seal of the concerned law firm when the plaintiffs proxy is an attorney.)

8Verified Statement of Address for Accepting Legal Documents (which shall be affixed with the official seal or signature of the plaintiff or the signature of the proxy.)

9The Business Registration Certificate or Household Registration Certificate of the Defendant.

10Original Version of List of Evidence

11Original Version of Evidential Materials (contents of which shall be arranged by the order of the List of Evidence, and materials in foreign languages shall come together with the corresponding Chinese translations.)

12Copies of List of Evidence (which shall be prepared according to the number of opponent parties).

13Copies of Evidential Materials (which shall be prepared according to the number of opponent parties and arranged by the order of the List of Evidence).
