I. Introduction to Shanghai Maritime Court

Shanghai Maritime Court was established in 1984 and currently has 10 internal institutions, namely Case Filing Chamber (Litigation Service Center, Litigation Mediation Docking Center, Petition Office), Maritime Division, Maritime Commerce Division, Executive Bureau, Yangshan Deep-water Port Dispatched Division (China (Shanghai) Pilot Free Trade Zone Division), Changxing Island Dispatched Division, Trial Supervision Division (Research Office, Trial Management Office, Execution Judgment Division), General Office, Political Department (Party Committee and Supervision Office) and Bailiff Team.

 

II. Jurisdiction and scope of cases accepted by Shanghai Maritime Court

The jurisdiction of Shanghai Maritime Court Shanghai coastal waters (including Yangshan Deep-water Port and nearby waters) and navigable waters of the Yangtze River starting from the estuary of Liuhe River

The types of cases accepted by Shanghai Maritime Court contain maritime infringement disputes, maritime contract disputes, open use and environmental protection of oceans and open sea waters disputes, other maritime disputes, maritime administrative cases and maritime special procedure cases. III. Scope of cases accepted by the dispatched divisions of Shanghai Maritime Court

. Yangshan Deep-water Port Dispatched Division (China (Shanghai) Pilot Free Trade Zone Division): mainly accepts maritime cases that either party (or both parties) is registered in China (Shanghai) Pilot Free Trade Zone, China (Shanghai) Pilot Free Trade Zone Lin-gang Special Area or Yangshan Deep-water Port.

. Changxing Island Dispatched Division: mainly accepts marine environmental protection cases involving the construction of Chongming Ecological Island and shipbuilding, ship trading, ship engineering and other maritime cases involving Changxing Island shipbuilding base and Chongming shipbuilding base. If the parties are legal persons or other organizations, the registration place of either party is located in Chongming District, or if the parties are natural persons, the domicile or habitual residence of either party is located in Chongming District.
