I. Application conditions for maritime injunction

. The applicant has a specific maritime claim.

. There is a need to rectify the respondent’s violation of the law or contract.

. The situation is urgent. Failure to make a maritime injunction immediately will cause damage or expand the damage.

. The guarantee provided by the maritime applicant shall be in accordance with the law.

 

II. Documents required for application for maritime injunction

. Application & evidence

The injunction application is in duplicate (original), indicating the name of the applicant, the name of the respondent, the requested items, the location the subject matter, the facts and reasons of the application, and the applicant's signature and seal. The name of the relevant ship, cargo mark, document number, etc. shown in the attached evidence should be consistent with the content recorded in the application.

. The letter of guarantee

Cash or the independent guarantee issued by financial institutions.

. Documents for the applicant's qualification

If the applicant is a natural person, it is required to provide the copy of Identification Card; if the applicant is a legal person or an incorporated organization, it is required to provide the copy of business license or organization code certificate and the identity certificate of the legal representative or the person chiefly in charge.

. Power of attorney

If the agent is a lawyer, it is required to provide a power of attorney, a copy of lawyers card and a letter of the law firm; if the agent is a company employee, it is required to provide the copy of the employee's identification card, a power of attorney, a copy of labor contract and the aforesaid documents should be affixed with the company's stamp.
